Covenant - Swimming Pools


Covenant

Swimming Pools. Swimming pools shall be located behind the front plane of the residence with minimum setbacks of 10 feet from the internal lot line (in accordance with Article II, Section 11 of the Declaration) and 5 feet from the rear lot line (in accordance with City of New Berlin Ordinance 238-3). This restriction applies to any swimming pool stationary for a period greater than 72 hours, including seasonal temporary pools. Owners are encouraged to shield their pools from view of the street.

Interpretation

The front plane of the residence is defined as the location of the home's front door in respect to the street. For example, if the front door rests behind the front-most portion of the home, the front plane is considered to be the location of the front door.

 

Enforcement of Covenants / Amendments

The topic of enforcement of the subdivision covenants was discussed at the March 2008 meeting. There were frequent problems with vehicle, trailer, and boat storage last year, and complaints were heard about a violation of the Swimming Pool amendment.

To address these concerns, the following statements were proposed for clarification of the two issues and what will be done to enforce them.

These statements were approved unanimously by residents and the officers have been tasked with ensuring that these and all the covenants are enforced in a fair but firm manner.
